The Supreme Court has held that rape charge cannot be invoked in case of consensual sex between live-in partners after a relationship ends and the man fails to marry her due to circumstances beyond his control. 'It said that such cases could be termed as a case of breach of promise to marry rather than a case of a false promise to marry," the court said.
